Darren McDowell

Darren McDowell is an associate attorney with Simon Greenstone Panatier, PC, and has been with the firm since 2008.

Darren’s practice primarily focuses on representing individuals diagnosed with mesothelioma and their families. He has handled cases both in state and federal courts across the country. Darren co-chaired a case to verdict, Lloyd S. Garvin, et al. v. AGCO Corporation a/k/a Allis Chalmers Company et al, which resulted in a verdict against various equipment manufacturers for an individual suffering from testicular mesothelioma. The verdict was a first of its kind, and was noted as one of the highest verdicts in South Carolina for 2013.

Darren is an invited member of the American Academy of Trial Attorneys, The National Trial Lawyers top 100, and was voted by his peers to the Texas Super Lawyers Rising Stars listing from 2006-2009. Additionally, Darren is a member of the American Association for Justice, the Texas Trial Lawyers Association and the Dallas Trial Lawyers Association. Darren also serves on the Board of Café Momentum, a non-profit restaurant providing jobs and life skills for at risk youth ranging in age from fourteen to eighteen.

Outcome: Significant verdict for Plaintiff, including compensatory damages and punitive damages against Bell Helicopter.
Description: Billy Dickson contracted mesothelioma and died as a result of exposure to asbestos while employed by Bell Helicopter. Plaintiffs proved that Defendants knew that asbestos was deadly long before Mr. Dickson was exposed to asbestos and never took any precautions to protect him. The Jury found that Bell Helicopter, Mr. Dickson’s employer, was grossly negligent in causing Mr. Dickson’s death.

Description: Lloyd Garvin contracted testicular mesothelioma as a result of asbestos exposure to various products including those sold by Durco, Crane Co. and Byron Jackson.  Plaintiffs proved at trial that these Defendants knew asbestos was deadly for decades prior to Mr. Garvin’s exposure, yet failed to warn him of those dangers and took zero precautions in order to protect workers like Mr. Garvin.

 

Viki Lynn Rogers, et al. vs. 3M Company, et al

Date: September 2014
Outcome: Significant Verdict for Plaintiffs including a gross negligence finding against the Employer, Kelly Springfield Tire Company/Goodyear.
Description: Carl Rogers contracted pleural mesothelioma and died as a result of exposure to asbestos while working as a tire maker for Kelly Springfield Tire Company/Goodyear located in Tyler, Texas.  Plaintiffs proved that his Employer, Kelly Springfield was grossly negligent because it knew of the dangers associated with asbestos exposure and not only failed to warn workers like Mr. Rogers, but also acted with conscious indifference to the health and safety of its employees by failing to implement any safeguards promulgated by OSHA.
